Ashok Bhan seeks setting up of Truth and Reconciliation Commission in J&K

Srinagar January 18 (KNS): Ashok BHAN  chairman Kashmir Policy and Strategy Group (KPSG) has said ,our group has been continuously holding (KATH-BHAAT);a dialogue by way of intra-civil society webinars,meetings and interactions through social media platforms,emphasising on the dire need for giving a closure to the sordid and brutal phase of societal devastation,death and destruction that has engulfed the larger south Asian region in general and Jammu & Kashmir in particular.


The Kashmir Valley carries a historical burden in a social context.The people are carrying the burden as victims of conflict from 1947 and continuing consequences of armed insurgency resulting in exile of the religious minority and killings innocent civilians  in the violence perpetrated by non State actors,others brutalised anti human groups including the State actors.
On the eve of holocaust day the 19th which is a black day in Kashmir’s glorious history.On this day the whole population of Kashmiri Pandit Community was exited by gun toting terrorists and since then are legal ving as refugees in their own Country.KPSG has always urged Union Government to engage with KPs and plan their safe and dignified return back home.34 years of exile is brutal.long and traumatic.They are the aborigines Kashmiri and are the prime stakeholders in the Kashmir affairs.Without KPs Kashmiri civilisational ethos is incomplete in these modern time and in Naya Kashmir Vision of idea of India.

NHRC,the Prime Minister and recently the Honourable Supreme Court have said :
NHRC said :the crimes committed against the Kashmiris and the native pandits was with intention to destroy in whole or in part a national,Ethinic and religious groups.The death & destruction suffered by people is Akin to Genocide.The objective of perpetrators is and was to separate the state from secular socio-political union of India and integrated it with Islamic State of Pakistan.

It is the talent,commitment to right to life and resilience of KPs that has failed terrorists and their masters who could not destroy this strong and viable entity the -Pandits the day is not far when this community will return home and contribute in revival of their recorded history and engraved roots.For this they need full and liberal political and economic support by the Union government.
The PM Narender Modi while speaking in and outside Parliament on the eve of abrogation of article 370 said :

Come let us all bring in a big change in the lives of people by ushering in new modern economic development and make it a resolve to solve all issues in JK affairs.He described it as Naya Kashmir mission.He said all those displaced from valley due to terrorism and political turbulence will receive all the logistical and liberal economic support to return to their homeland for full enjoyment of peaceful & secured life and liberty.

The honourable SupremeCourt in its legal and institutional wisdom has shown a way forward ;

The Apex Court speaking through a Constitution bench recently while delivering judgement on the article 370 said,While the judgment of the Constitution Bench of the Supreme Court of India regarding Article 370 will continue to invite intense scrutiny and analysis by legal and political pundits, the broader message from the honourable judges is loud and clear: Move forward and focus on the future of Jammu and Kashmir rather than brood  over its sordid past!

While delivering the unanimous judgment on the jurisprudence on the inoperability of Article 370 of the Constitution, the honourable Judges have empathically held a view that social fabric is waning and inter generational trauma has already fractured the Kashmiri Society.In order to heal the wounds and make a forward movement and restore coexistence,tolerance,mutual respect and communal & societal harmony.

A TRUTH & RECONCILIATION COMMISSION should be set up expeditiously.The Commission will investigate and report on the human rights violations by non state and state actors perpetrated in Jammu & Kashmir at least since 1980s and recommend measures for reconciliation.Honourable Judge said before the memories fade and escape the exercise shall be time bound.

The loud and clear message thus is ;

*Constitute a truth and reconciliation commission.
*Engage with Stake holders and particularly the Exiled Kashmiri Pandits And;  Union Government shall create a time bound Plan for the safe dignified and with political empowerment-Return of the exiled natives back in the Valley.
*Revive the ASTITV of JK people that is hurt by bifurcation of the State. RESTORE the Statehood.

*HOLD the elections and keep moving the Institutional democracy.
*In constitutional democracy election is a rule and governor rule is temporary as an exception.(KNS)
