High Court Rules Against Regularization of Casual Workers

Jammu, Feb 16 (KNS): The Division Bench of Jammu & Kashmir and Ladakh High Court, comprising Justice Atul Sreedharan and Justice Moksha Khajuria Kazmi, has declared that casual workers have no right to regularization and their services can only continue on a need basis funded by the Government.

The bench addressed appeals against a writ court's decision, which refused regularization but ordered the release of legitimately earned wages for the period worked by the appellants.

The case centered on Government Order No.Click Here To Follow Our WhatsApp Channel585-HME of 2014, which created/upgraded sub-centers in the Health Department and hired 1284 casual workers as Nursing Orderlies for the newly established institutions.

Despite sincere performance of duties, the petitioners' plea for regularization based on continuous service as casual workers was rejected.

The Division Bench upheld the writ court's judgment, dismissing the appeals but directing the release of legitimately earned wages within four weeks.(KNS)
